Welcome to Embryk. These terms and conditions apply to all offers, orders and agreements made with Embryk through the web shop. By placing an order with Embryk, you agree to the terms and conditions below.

General

These general terms and conditions apply to every offer of Embryk and every distance contract with the consumer.
The text of these terms and conditions will be made available prior to the agreement and will be sent free of charge upon request.
If provisions are null and void or annulled, other terms and conditions will remain valid and a replacement provision will be drawn up in consultation.

Offers and agreements

All offers of Embryk are non-binding and are valid while supplies last. Prices can be changed based on legal requirements.
An agreement is concluded upon acceptance by the consumer and confirmation by Embryk.
In case of electronic acceptance, the consumer receives a confirmation. Without this confirmation, the consumer can dissolve the agreement.

Prices and Payments

All prices are in euros, including VAT and excluding shipping costs, unless otherwise indicated.
Payment can be made by the methods offered in the ordering process. Additional conditions may be imposed.
The payment date is the date the amount is received by Embryk.

Shipping and delivery

Delivery times: Deliveries within Europe are made within 4-6 business days, depending on the carrier. Embryk will make every effort to deliver within the specified time frame.

Delays: In case of delays, the consumer will be informed immediately and given the opportunity to rescind the contract free of charge.

Delivery Address: The address provided by the consumer counts as the delivery address. Please ensure this is correct and complete, as Embryk is not responsible for errors in address information.

Track & Trace: After placing the order, the consumer receives a Track & Trace code that allows easy tracking of the order.

Non-delivery: If a package cannot be delivered due to incorrectly provided information or the absence of the recipient, the consumer may be charged additional shipping costs for another attempt.

Right of withdrawal and return policy

Reflection period: Consumers are entitled to a 14-day reflection period from the day of receipt of the product.

Return: Product must be returned unused, in original condition and packaging. Damaged or used products are not eligible for refund.
If the product is not in good condition or does not arrive as a return we reserve the right not to issue a refund.

Return Procedure: The consumer must notify the return request via email within 14 days of receipt.
Embryk will then provide further instructions for the return.

Cost: The consumer bears the cost of the return unless otherwise stated or agreed upon.
Personalized Items: Products personalized specifically for the consumer cannot be returned.

Refund: Upon receipt and inspection of the returned product, the full purchase price will be refunded within 14 days, provided the product is in good condition.

Damaged deliveries: If a product is delivered damaged, this must be reported immediately to the carrier as well as Embryk. Photos of the damage are required as proof.

Liability and warranty

Quality and Safety: Embryk is committed to high quality products, especially in the area of Montessori materials. However, parental supervision is essential while using these products.

Warranty: Products are delivered in perfect condition. If a product is found to be defective or damaged upon receipt, Embryk will provide an appropriate solution, such as replacement.

Consumers must report defects with supporting evidence (photos) within 14 days of receipt.
Exclusions: Damage due to wear and tear, improper use or negligence is excluded from the warranty.

Force majeure

Embryk is not liable for delays or damages caused by force majeure. Force majeure includes, among others, natural disasters, strikes, pandemics, war or technical failures.
In case of force majeure, the consumer will be informed immediately and a suitable solution will be sought in consultation.

Complaints and disputes

Submission of complaints: Complaints about orders or products should be submitted fully and clearly described via e-mail.

Response Time: Embryk will respond within 14 days with a substantive response or an indication of the processing time required.

Disputes Committee: Disputes can be submitted to the Geschillencommissie Webshop (www.sgc.nl) or the Dutch courts.
